
Terms and Conditions of Sale and Use – SwissClear

These Terms and Conditions of Sale and Use ("T&Cs") govern access to and use of the SwissClear platform (www.swissclear.ch). By using the platform or placing an order, you acknowledge and agree to be bound by these terms.

SwissClear operates with a dedicated logistics entity within the European Union to handle purchases, warehousing, and shipments into Switzerland.
2. Purpose
SwissClear enables Swiss customers to order products available on third-party online stores (primarily in the EU) while benefiting from a fully integrated service that includes:
VAT-exempt purchasing
Customs clearance
Swiss VAT payment
Final delivery to home or a pickup point
3. Use of the Platform
The SwissClear platform is intended for adults with full legal capacity.
Account creation is required to place an order.
Users are responsible for providing accurate and up-to-date information.
4. Order Process
The user copies the URL of a product from a third-party site (e.g., Amazon, Zalando) and pastes it into SwissClear.
A full cost estimate is generated: VAT-exempt price, shipping, customs duties, Swiss VAT, and SwissClear service fee.
The user confirms the order and proceeds to secure payment.
SwissClear (through its EU-based entity) purchases the item on behalf of the user.
The item is imported into Switzerland and delivered to the user’s home or a nearby collection point.
5. Pricing & Payment
All prices are displayed in Swiss francs (CHF) and include Swiss VAT.
No additional fees will be charged after order confirmation.
Payment is processed securely via Stripe, TWINT, or any other supported method.
An invoice is generated and sent to the user.
6. Delivery
Delivery is available across Switzerland, either to the user’s address or a SwissClear pickup point.
Standard delivery times range from 2 to 7 business days following order confirmation.
SwissClear will notify users in case of any customs or transport delays beyond its control.
7. Returns & Cancellations
Return policies follow the rules of the original seller.
SwissClear assists in the logistics of the return but cannot guarantee acceptance by the original seller.
Return shipping costs are the responsibility of the user unless otherwise stated.
Orders can be cancelled free of charge before SwissClear proceeds with the purchase.
8. Liability Disclaimer
SwissClear is not liable for product defects, misrepresentation, or failures from third-party sellers.
SwissClear is not responsible for the availability or accuracy of listings on external websites.
SwissClear is committed to handling logistics, customs, and delivery with professionalism and care.
9. Pickup Points
SwissClear offers a network of pickup points throughout Switzerland.
The user selects the preferred pickup location when ordering.
Notification is sent via SMS or email once the item is ready for collection.
10. Personal Data Protection
SwissClear complies with Swiss data protection law (nFADP) and the GDPR.
Data is processed strictly for order fulfillment, invoicing, delivery, and customer service purposes.
No data is shared with non-essential third parties.
11. Intellectual Property
All content on the site (texts, images, structure, branding) is protected under copyright.
Any reproduction, distribution, or commercial use without written permission is prohibited.
12. Governing Law and Jurisdiction
These T&Cs are governed by Swiss law.
The competent courts of the Canton of Geneva shall have exclusive jurisdiction for any dispute, subject to appeal to the Swiss Federal Tribunal.
13. Modifications
SwissClear reserves the right to amend these T&Cs at any time. The version in force at the time of the order shall apply.
