1. About SwissClear

SwissClear is a cross-border e-commerce platform that enables Swiss consumers to purchase products from European merchants at a fully inclusive CHF price, including Swiss VAT (8.1%), customs duties, shipping costs, and the SwissClear service fee.

The platform is operated by:

2. Scope of Application

These Terms and Conditions of Sale and Use govern all contractual relationships between SwissClear and any user of the swissclear.world platform. By accessing the platform or placing an order, the user unconditionally accepts these terms.

3. Services Offered

3.1 Concierge Purchasing Service

SwissClear acts as an intermediary and purchasing agent. SwissClear is not the direct seller of the products but purchases products on behalf of the customer from European merchants (including Amazon Business).

3.2 All-Inclusive Pricing

The price displayed in CHF on the platform includes:

  • The product price converted to CHF at the current exchange rate
  • EU → Switzerland transportation costs
  • Applicable Swiss customs duties
  • Swiss VAT at 8.1%
  • SwissClear service commission
  • Logistics processing fees

This price is indicative and may vary slightly due to exchange rate fluctuations at the time of order finalisation.

4. Order Process

4.1 Search and Selection

The user searches for a product on swissclear.world by entering a product URL or keyword. SwissClear displays the product information along with an all-inclusive estimated price in CHF.

4.2 Confirmation and Payment

The order is confirmed after full payment on the platform. Payments are processed securely via Stripe, PostFinance Checkout (TWINT, PostFinance Pay), or PayPal.

4.3 Purchase and Shipment

After payment confirmation, SwissClear proceeds to purchase the product from the European merchant. The product is delivered via the SwissClear logistics network (Parcelontime + Asendia) to the customer's address in Switzerland.

5. Delivery

Estimated delivery times are 5 to 10 business days from payment confirmation. These timelines are indicative and may vary based on product availability, logistics timelines, and any customs checks.

SwissClear cannot be held liable for delays attributable to third parties (carriers, customs services, Swiss Post).

An Asendia tracking number is provided to the customer upon shipment.

6. Pricing and Payment

All prices are displayed in CHF and include all taxes and fees described in Article 3.2. Full payment is required at the time of order. SwissClear reserves the right to modify its pricing at any time, without retroactive effect on already confirmed orders.

7. Return and Refund Policy

SwissClear acts as an intermediary between the customer and the European supplier. As such, SwissClear makes every effort to facilitate the processing of return requests, but cannot be held responsible for the return conditions imposed by the supplier and cannot respond on behalf of the supplier.

The applicable return conditions are primarily those of the supplier from whom the product was purchased. SwissClear undertakes to forward any return request to the relevant supplier as soon as possible.

The customer has 14 days from receipt of the product to initiate a return request, in accordance with Swiss law (CO Art. 40a et seq.) and applicable regulations.

General return conditions are as follows:

  • The product must be returned in its original condition, unused and in its original packaging
  • Return shipping costs are borne by the customer, except in cases of defective or non-conforming products
  • Refunds, if granted by the supplier, are processed within 14 business days after receipt and inspection of the return
  • The SwissClear service commission is non-refundable in the absence of a proven defect
  • SwissClear cannot guarantee acceptance of the return if the supplier refuses the request under their own conditions

8. Liability

8.1 Limitation of Liability

SwissClear acts as an intermediary and cannot be held liable for:

  • Product defects or non-conformities attributable to the manufacturer or original seller
  • Indirect damages, loss of revenue, or intangible prejudice
  • Delivery delays due to circumstances beyond its control
  • Price variations due to exchange rate fluctuations

8.2 Force Majeure

SwissClear is released from all liability in cases of force majeure, including: natural disasters, pandemics, strikes, government decisions, or customs blockades.

9. Personal Data Protection

SwissClear processes users' personal data in compliance with the General Data Protection Regulation (GDPR) and the Swiss Federal Act on Data Protection (FADP). For more information, please refer to our Privacy Policy available on swissclear.world.

10. Intellectual Property

All content on swissclear.world (texts, images, logos, interface) is the exclusive property of SwissClear and is protected by applicable intellectual property laws. Any reproduction, even partial, is strictly prohibited without prior written authorisation.

11. Governing Law and Jurisdiction

These Terms and Conditions are governed by Swiss law. In the event of a dispute, the parties agree to seek an amicable resolution. Failing that, the competent courts of Geneva, Switzerland, shall have exclusive jurisdiction.

12. Amendments

SwissClear reserves the right to amend these Terms and Conditions at any time. Amendments take effect upon publication on the platform. Continued use of the platform after modification constitutes acceptance of the new terms.
